1) Introduction

Welcome to Fanelix.com (“Fanelix”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of Fanelix.com, our apps, and any related features or services (collectively, the “Services”).
By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Important: These Terms include disclaimers of warranties, limitations of liability, and a governing law clause. Please read carefully.

 

2) Eligibility

  • You must be 18+ years old (or the age of majority in your jurisdiction).

  • If you use the Services on behalf of an entity, you confirm you’re authorized to bind that entity to these Terms.

 

3) Accounts & Security

  • Some features require an account. Provide accurate information and keep it up to date.

  • You’re responsible for safeguarding your credentials and for all activity under your account.

  • Report any unauthorized access to contact@fanelix.com immediately.

 

4) Your Content & Our License

  • You own the content you upload or share (“User Content”).

  • By posting User Content, you grant Fanelix a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, and display your content as reasonably necessary to operate, improve, and promote the Services.

  • You promise you have the rights to your content and that it does not violate laws or third-party rights.

 

5) Our Content & Intellectual Property

  • The Services and their materials (code, design, text, graphics, trademarks, etc.) are owned by Fanelix or its licensors and protected by IP laws.

  • Except as permitted by law, you may not copy, modify, distribute, reverse engineer, or create derivative works without written consent.

 

6) Acceptable Use

You agree not to:

  • Break laws or infringe third-party rights.

  • Post or share content that is illegal, defamatory, infringing, exploitative, or otherwise harmful.

  • Harass or impersonate others, or incite violence/self-harm.

  • Introduce malware, attempt to bypass security, scrape/probe without permission, or disrupt the Services.

  • Use automated tools (bots/crawlers/scripts) except as expressly permitted.

Fanelix may moderate, restrict, or remove content or accounts to protect users, comply with law, or preserve platform integrity.

 

7) Fees, Payments & Refunds

  • Some features are paid (e.g., subscriptions, access fees, purchases). You authorize Fanelix and our payment processors to charge your selected payment method for all amounts, taxes, and fees.

  • Prices may change; for recurring charges we’ll provide reasonable advance notice.

  • Refunds: Unless a separate policy states otherwise or the law requires it, all sales are final and non-refundable.

  • You’re responsible for applicable taxes (excluding taxes based on our net income).

 

8) Third-Party Services

  • The Services may integrate or rely on third-party providers (e.g., payment processors, hosting/CDN). Your use of them may be subject to their terms and privacy policies.

  • Fanelix is not responsible for third-party content, services, failures, or actions.

 

9) Privacy & Data

  • Your use of the Services is also governed by our Privacy Policy and Cookie Policy (when published).

  • We may process personal data as necessary to provide, secure, and improve the Services, in line with those policies.

 

10) Copyright Complaints (DMCA-Style)

If you believe content on the Services infringes your copyright, email contact@fanelix.com with:

  • Your full name and contact details.

  • A description of the copyrighted work and the allegedly infringing material (specific URLs).

  • A statement of good-faith belief that the use is not authorized.

  • A statement, under penalty of perjury, that the information is accurate and you are the owner or authorized agent.

  • Your electronic or physical signature.

 

11) Suspension & Termination

  • We may suspend or terminate access immediately for violations of these Terms, legal requests, security risks, or to protect users.

  • You may stop using the Services at any time. Provisions that should survive termination (e.g., IP, payments due, disclaimers, liability limits, indemnity, governing law) will survive.

 

12) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, secure, or error-free.

 

13) Limitation of Liability

To the maximum extent permitted by law, Fanelix and its affiliates, officers, employees, agents, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services.
Our aggregate liability for all claims is limited to the greater of £100 GBP or the amount you paid to us for the Services in the 12 months before the claim.

 

14) Indemnification

You agree to indemnify and hold harmless Fanelix and its affiliates, officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to (a) your use of the Services, (b) your User Content, or (c) your breach of these Terms or applicable law.

 

15) Governing Law & Jurisdiction

  • These Terms are governed by the laws of England & Wales, excluding conflict-of-law rules.

  • The courts of England have exclusive jurisdiction over disputes, unless mandatory consumer law provides otherwise.

  • UK/EU consumers may have non-waivable rights under consumer protection laws.

 

16) Changes to Services & Terms

  • We may add, change, or discontinue features at any time.

  • We may update these Terms. The “Last updated” date will change, and for material changes to recurring paid features we’ll give reasonable advance notice. Continued use after changes become effective means acceptance.

 

17) Miscellaneous

  • Severability: If any provision is unenforceable, the rest remain in effect.

  • No Waiver: Failure to enforce a provision isn’t a waiver.

  • Assignment: You may not assign these Terms without our consent. We may assign in connection with a merger, acquisition, reorganization, or asset sale.

  • Entire Agreement: These Terms plus any referenced policies are the entire agreement between you and Fanelix regarding the Services.
